In many ways, 2010 was an eventful year on the regulatory front, with some potential precedents and unexpected reversals occurring that will potentially affect the ESC industry. Probably the most closely watched, though, was the Effluent Guidelines for Discharges from the Construction and Development Industry—from the issuing of the final rule to the debates over the technology and funding needed to comply with it to the ongoing legal challenges.
Back in January, soon after the final rule was published in the Federal Register, we ran a brief summary of what it contained, including the much-anticipated 280-NTU turbidity limit.
An article in the May issue of Erosion Control and another in the September/October issue expanded on the rule and its implications.
Now, following some legal disputes, it’s back in EPA’s court, as this guest editorial from the November/December issue explains.
